How does that make sense? Sounds like it doesn't quite break the law. The covering, although small, might be enough. According to The New York Post, the incident happened on an Upper East Side Q train. In the picture that's going viral, you see he is quite exposed. The New York Post says that police sources say that while his attire might be provocative it did not constitute exposing himself. People having been comparing him to a sex offender in the area but no word on if it's actually him.
As someone who used to take a subway to work, you never know what you're going to see on one of these trains. I've seen more than I've wanted to and stuff that definitely would count as exposing yourself. It was not a great sight.
